1. SERVICES
GoSWDS (operated by Oliver, Philippines) provides website design & development, business email setup, and social media marketing services. The scope, timeline, and deliverables for each project are agreed in writing before work begins.
2. PAYMENT
A 50% deposit is required before work begins on any project. The remaining 50% is due upon completion and before final files or access credentials are handed over. Monthly retainers (social media management) are invoiced at the start of each month.
Payments are accepted via GCash, bank transfer, or PayPal. All prices are in PHP (Philippine Peso) or EUR as quoted, inclusive of applicable taxes unless stated otherwise.
3. REVISIONS
All project packages include two (2) rounds of revisions. Additional revisions beyond this are charged at ₱1,500 per hour or as agreed in writing.
4. INTELLECTUAL PROPERTY
Upon receipt of final payment, you own all custom design work, copy, and code created specifically for your project. GoSWDS retains the right to display the completed work in its portfolio unless you request otherwise in writing.
Third-party assets (stock photos, fonts, plugins) remain subject to their respective licenses. I will always use properly licensed assets in your project.
5. TURNAROUND & DELAYS
Project timelines begin once the deposit is received and all required content/assets are provided by the client. GoSWDS is not responsible for delays caused by late content submission or unresponsive clients. If a project is paused for more than 30 days due to client delays, a restart fee may apply.
6. HOSTING
Website hosting is not included in project fees unless explicitly stated. I will set up and configure hosting (typically ShockHosting) as part of the project, but ongoing hosting fees are paid directly to the hosting provider by the client.
7. SATISFACTION GUARANTEE
If you are not satisfied with the final design after two revision rounds, I will refund 50% of the project fee. This guarantee applies to design services only and does not cover third-party costs (domains, hosting, plugins).
8. CANCELLATION
If you cancel a project after work has begun, the deposit is non-refundable. If GoSWDS cancels a project, a full refund of the deposit will be issued.
For social media management retainers: you may cancel with 30 days' written notice after the initial 3-month minimum term.
9. LIMITATION OF LIABILITY
GoSWDS is not liable for any indirect, incidental, or consequential damages arising from the use of delivered services. Total liability is limited to the fees paid for the specific project in question.
10. GOVERNING LAW
These terms are governed by the laws of the Republic of the Philippines. Any disputes will be resolved in the courts of Quezon City, Philippines.
11. CHANGES TO THESE TERMS
I may update these terms from time to time. Continued use of GoSWDS services after an update constitutes acceptance of the revised terms.
